Copyright and Fairness

We haven't talked much about copyright and digital media in class, but the question has come up as my group puts together our video project (particularly with the soundtrack). In light of our questions, this article (among others) highlights some of the issues and misconceptions that surround copyright and fair use and also highlights the power that comes with the instantaneous access and publishing abilities of the web. It also again demonstrates the strange and mighty power of Neil Gaiman, who, in addition to being unbelievably rad and an amazing writer, is also an Internet superstar and his followers are a force to be reckonded with -- see this article and the Tweet heard round the world for a story about stationery company Paperchase and another instance of potential plagiarism.
On the other side of the argument (or somewhere further down the spectrum at any rate), is this video:

What is inspiration (mostly regarding Paperchase story) and what is outright theft?
